Opinion Piece on the illegality of Nuclear Weapons: 8th July 2006

Ten years ago, on 8th July 1996, the highest court in the world announced that the threat or use of nuclear weapons was contrary to the rules of international law, including the laws governing armed conflict, international humanitarian law, and environmental law. This advisory opinion of the international Court of Justice in The Hague was issued at the request of the General Assembly of the United Nations.

The International Court of Justice also made an important statement regarding Article VI of the Non-Proliferation Treaty. The treaty states that all nuclear weapon states must actively work towards nuclear disarmament. The International Court of Justice clarified this by stating clearly and simply that so long as the end goal of total nuclear disarmament has not been reached, all nuclear weapon states are in breach of international law.

It is high time to bring ourselves in line with the rules of international law. An important step could take place during the NATO summit dealing with the modernisation of NATO in the 21st Century, which will be held in Riga (Latvia) in November. The United States is currently the only country to deploy nuclear weapons outside its own territory. 480 US tactical nuclear weapons, of type B61, are currently stored in six European countries (Germany, UK, the Netherlands, Italy, Turkey and Belgium). There are 20 of these weapons at the Belgian NATO airbase of Kliene Brogel. Just one B61 nuclear weapon contains the explosive power of 170 million kilograms of high explosive, making it 14 times as powerful as the bomb that destroyed Hiroshima. In Hiroshima around 140,000 of the 350,000 inhabitants were dead by the end of the year. Many thousands more died over the following years as a result of the radiation. The victims included children who were not yet born at the time of the explosion.

The nuclear weapons at Kleine Brogel are officially under US control, however the nuclear sharing? agreement within NATO means that Belgian pilots are trained to fly these weapons of mass destruction. In times of conflict, Belgian F16s would be used to carry these bombs to their target. Nuclear weapons are a crime against humanity. For this reason, there must be a serious discussion in parliament and society, regarding the role of the US nuclear weapons in Europe, and the military and political consequences of keeping these weapons.

The continued deployment of nuclear weapons in six European NATO member states countries seriously undermines the legitimacy of the struggle against the spread of nuclear weapons. States such as North-Korea, India, Pakistan, Israel and Iran have developed illegal nuclear weapons, or at least have made attempts to do so, on the basis of so-called civilian nuclear materials, supposedly imported for the generation of nuclear power. These states justify these weapons by referring the presence of illegal nuclear weapons in Europe, and they copy to the official rhetoric of the NATO alliance when they claim that these nuclear weapons are necessary for ‘security’, and that they guarantee ‘stability and balance in the region’. How long will it be before Pakistan copies our concept of ?nuclear sharing? and installs its own nuclear weapons on the territory of its allies in the Middle-East?

The presence of US nuclear weapons in Belgium and elsewhere in Europe work for, rather than against, the spread of nuclear weapons. The Flemish Parliament, the Belgian House of Representative and the Belgian Senate have all passed resolutions calling for the withdrawal of illegal US nuclear weapons from Europe. These resolutions must be acted upon. The Belgian government must take the initiative to place this issue on the agenda of the NATO summit in Riga at the end of 2006. In the past, US nuclear weapons have been withdrawn from Iceland, Denmark (Greenland), Canada, and Greece, without putting membership of NATO or the cohesion of the alliance in danger.

Today, exactly ten years after the historic judgement of the International Court of Justice in The Hague, the undersigned make a call on the Belgian government to work on this issue. At the same time, they call on all citizens to take part in the nonviolent blockade of Kleine Brogel that will take place on 9th August 2006. This is the 61st anniversary of the atomic bombing of Nagasaki, three days after the bombing of Hiroshima.
